Do you have grounds for an appeal?

If you are seeking advice in relation to appeal against a sentence or conviction Leslie Franks Solicitors have expertise and experience in all areas of the appeals process.

Appeals & Reviews

After your trial or sentence you may feel like the result is unjust. You may think that important points were not raised in your defence or the sentence you received was excessive. If this is the case, you have the right to ask for a review of this decision.

We have a proven track record for having miscarriages of justice overturned. We will start by reviewing all the issues in your case and advise you on the merits of a potential appeal. This will include comprehensive advice on issues in regards to sentencing such as length, validity in law and possible variations due to unforeseen circumstances. Convictions can also be challenged and we will advise you on any errors in law, unfair or unreasonable decisions, unconsidered evidence or procedural mistakes.

Where we identify an issue that might merit an appeal, we can draft and lodge the appeal and represent you at the Crown Court or Court of Appeal to present your appeal to the Court. Our team of advocates are experienced in dealing with appeals in both the Crown Court and the Court of Appeal and so are well positioned to guide you through the whole process.

Each court has strict rules on the time limit for lodging an appeal. If your case was heard in the Magistrates’ Court then an appeal must be lodged within 21 days of the Court sentencing you. If your case was heard in the Crown Court then the time limit is 28 days. In certain circumstances the court may be willing to hear an appeal lodged outside of these times, however it is vital that you contact us as soon as possible to discuss whether we are able to lodge an appeal on your behalf.
