Drink Driving

A conviction for drink driving must be punished with a driving disqualification in addition to another form of punishment unless there are 'special reasons'. The length of the disqualification and the punishment will depend on the level of alcohol in the specimen taken at the Police station (measured in breath, urine or blood).

It is also an offence to fail to provide a specimen for analysis. This carries a disqualification the length of which will depend on the circumstances of the case.

In order to successfully prosecute you for this offence, there is a set procedure that the Police must follow and if the Police fail to follow this procedure, then the irregularity may result in your acquittal.

There are however other factors such as pre-existing medical conditions and prescription drugs that may affect the accuracy of the reading and we will be able to help you explore these issues prior to attending Court.
